Against life imprisonment

UCLM. 2016.

Editors: Luis Arroyo Zapatero, Juan Antonio Lascuraín Sánchez and Mercedes Pérez Manzano.

The incorporation into the Criminal Code of life imprisonment in the 2015 reform has received an almost unanimous rejection by Spanish criminal science, which censors it for its frontal opposition to our Magna Carta by violating the prohibition of inhuman and degrading punishments (art. 15), the principles of guilt and proportionality, the right to liberty (art. 17), the mandate to determine sentences (art. 25.1) and that of resocialization (art. 25.2). This book is the result of the debate doctrine raised in the framework of the preparation and presentation in Congress of the opinion on the constitutionality of the reviewable permanent prison sentence entrusted by the Socialist Parliamentary Group of Congress and whose content has been reflected in the unconstitutionality appeal presented by it and supported by all political parties then in opposition. The opinion is accompanied by complementary works by the authors and by a qualified group of professors united in the censorship of life imprisonment: Gonzalo Quintero Olivares, Francisco Javier Álvarez García, Francisco Javier de León Villalba, Nicolás García Rivas, Adán Nieto Martín, Juan Antonio Lascuraín Sánchez, José Luis de la Cuesta Arzamendi, Antonio Cuerda Riezu, Lucía Martínez Garay, María Acale Sánchez, Carlos García Valdés and Tomás Vives Antón.
